Under California Penal Code § 1203.4, you may obtain an expungement if you:

Have completed probation (or have been discharged of your probation); and
-
Are currently not serving any sentence for any offense.
Once filed, the judge has ultimate discretion to expunge your criminal record. At this time, you will be permitted to withdraw your plea of guilty or nolo contendere and enter a plea of not guilty. If you were convicted of a crime, the judge can set aside the jury’s findings.
NOTE: Not all crimes are eligible for expungement. Also, a successfully expunged conviction may reappear on your record if you are convicted of a crime at a later time.
