Possession of a Controlled Substance
Under California Health and Safety Code section 11350 possession of a “controlled substance” without a valid prescription can be punishable by imprisonment in state prison. California Health and Safety Code section 11351 prohibits the possession of a controlled substance for the purposes of sale, which is a felony offense and can result in a two, three, or four year jail term.
Generally, a controlled substance is:

Opiates and opiate derivatives; and

Gamma-hydroxybutyric acid (GHB).
