A permanent resident is authorized to live and work in the United States indefinitely.  You may obtain permanent resident status in several different ways.  Typically, individuals are sponsored by family members or employers in the United States, but other avenues are available.  The steps necessary to obtaining your permanent resident card (“green card”) are different for each category.  Keepin in mind,  even the smallest mistake on paperwork or one missed deadline may hinder your chances of receiving a Green Card.

Family Sponsorship

An individual may obtain a green card in the United States through family sponsorship. All U.S. citizens may sponsor immediate relatives to come live and work in the United States as permanent residents.  Immediate relatives eligible are:

  • Spouses
  • Unmarried children
  • Married children
  • Parents
  • Siblings

Permanent residents of the United States may only sponsor spouses and unmarried children.

Applying for permanent residency through family sponsorship is a multi-step process that can, at times, feel overwhelming.  Both the sponsoring U.S. Citizen or permanent resident and the beneficiary of the petition will need to get involved and provide documents and information during the process.  Gupta & Trujillo can ensure that all of the form requirements and standards of proof have been met to help secure a successful completion of the family sponsorship.

Employment Sponsorship

An individual who has a permanent employment opportunity in the United States may be eligible for a green card through employment sponsorship.  This is a very lengthy and complex process requiring:

  • A job offer from a U.S. Employer;
  • A Labor Certification.  (Please see our section on PERM Labor Certification for additional information on this process);
  • A Petition for Alien Worker filed by the employer on behalf of the foreign worker; and
  • The foreign worker file an Application to Adjust Status. 

Gupta & Trujillo can assist you through this lengthy and demanding multi-step process, which requires your involvement as well as the involvement of your employer.  The process of obtaining permanent resident status through employment sponsorship is extremely complex and time consuming.  From beginning to end, the application process can take more than two years.  With our knowledge and familiarity with the processes, you will be in good hands each step of the process.

Green Card Through Investment

An individual who has invested in a commercial enterprise in the United States, which will preserve or create ten permanent full time jobs for qualified U.S. workers, is eligible for a green card through this investment.  In order to qualify, the foreign national must invest $1,000,000.00 or $500,000.00 in a targeted employment area. 

If those requirements are met, USCIS may grant a conditional permanent resident status to the foreign investor.  This conditional permanent resident status may be converted to an unconditional permanent resident status, upon meeting certain requirements.

NOTE: USCIS authorizes a limited number of these visas per fiscal year.

Diversity Visa Lottery

Each year, the Diversity Immigrant Visa Program makes 50,000 green cards available to applicants drawn at random and who are from countries with low rates of immigration to the United States.  In order to be eligible for the Diversity Immigrant Visa Program, you must:

  • Be selected for the Diversity Visa Lottery Program by the U.S. Department of State
  • Have an immigrant visa immediately available to you at the time you file Form I-485, Application to Adjust Status
  • Be admissible to the United States
